The civil trial over the 2010 Deepwater Horizon oil rig disaster, which was due to start in New Orleans on Monday, has been delayed for a week, to allow for further talks on a settlement.

The trial is to resolve claims for damages and civil penalties.

BP has so far paid $7.5bn in clean-up costs and compensation.

In a joint statement, BP and the Plaintiffs' Steering Committee - a group of lawyers representing victims of the spill, confirmed that the trial would now start on 5 March.

"This adjournment is intended to allow BP and the PSC more time to continue settlement discussions and attempt to reach an agreement," the statement said.

"BP and the PSC are working to reach agreement to fairly compensate people and businesses affected by the Deepwater Horizon accident and oil spill. There can be no assurance that these discussions will lead to a settlement agreement," the statement added.

One lawyer close to the case told the BBC that the different parties were still far apart in negotiations over settlements.

The spill released more than four million barrels of crude oil from BP's Macondo well.

BP and its partners face the threat of tens of billions of dollars in fines and penalties if found grossly negligent in the case.

The UK firm is expected to blame its main contactor, Halliburton, which is a fellow defendant.

US President Barack Obama called the spill "the worst environmental disaster the nation has ever faced".

It took 85 days to permanently stop the release of crude oil.

Ex-judge in US defends forced abortion ruling

BOSTON (AP) ? A retired Massachusetts judge on Tuesday defended her decision to order a mentally ill woman to have an abortion and be sterilized against her wishes, and she blasted Boston University for rescinding a job offer after her ruling sparked controversy.

Christina Harms said she believes the schizophrenic woman would have chosen to have an abortion if she had been mentally competent. In her ruling, she granted a petition from the woman's parents to have their daughter declared incompetent and awarded guardianship to them for the purpose of consenting to the abortion.

Harms' ruling drew spirited debate among bloggers on both sides of the abortion issue. Her written ruling remains sealed under family court rules, but the gist of it became public after the state Appeals Court overturned the decision on Jan. 17.

Now Harms has taken the unusual step of defending her decision publicly, both in media interviews and in a letter she sent Monday to other family court judges in Massachusetts. The Boston Globe newspaper first reported on the judge's letter.

Harms, who retired six days before the Appeals Court ruling, said a decision by Boston University's School of Law to back out of a job offer shortly after the Appeals Court overturned her ruling sends the wrong message about judicial independence.

"Being a judge is not like being a contestant on 'American Idol,' " Harms told The Associated Press on Tuesday, referring to the reality television show. "You are not looking for votes."

The woman has not been named; she was identified in court papers only as "Mary Moe."

Harms said many factors went into her decision in favor of the abortion, most importantly, concerns about the woman's health. She said the woman had been taken off some of her anti-psychotic drugs because the medications could have harmed the fetus. After hearing from the woman herself and from her parents, Harms said she found that the woman had severe delusions ? including her belief that she was not pregnant ? and was not competent to decide whether to have an abortion. Harms said she also found that the woman, if she had been mentally competent, would have chosen an abortion to protect her own well-being.

"I viewed the interruption of Mary's full medical regimen as potentially life-threatening. If Mary understood this, which my observation of her behavior, demeanor, and responses indicated that she did not, I believed then, as I do now, that she would elect to abort the pregnancy in order to protect her own well-being," Harms wrote in her letter to her former colleagues on the bench.

Harms said she had been negotiating with BU's law school since August about a newly created position where she would help the school in its efforts to increase the number of judicial clerkships and internships offered to its law students. On Jan. 17 ? the day the Appeals Court ruled ? she said she received an email from a BU official asking her to send a short biography and photo to introduce her to the law school community. Three days later, after a media flurry about her ruling, she said she got an email from the school canceling an appointment she had to fill out paperwork for the job.

BU says it never made a formal job offer to Harms, but it acknowledges that the controversy created by her ruling contributed to the decision to take her out of the running for the job.

In a letter to Harms' lawyer, BU's deputy general counsel, Erika Geetter, said that it was not disagreement with the content of the judge's ruling that caused the school not to move forward on the job. Geetter said the job was a position that would require Harms to do marketing within the school and the legal community.

Harms said she believes the school would not have made the decision if her ruling had involved an issue other than abortion.

In overturning Harms' decision, the Appeals Court used unusually strong language.

The court said no one had requested sterilization and said Harms "appears to have simply produced the requirement out of thin air."

Harms said she based her sterilization order on concerns that the woman had had two previous pregnancies and would continue to have unprotected sex, unplanned pregnancies and therefore "serial abortions." The woman had aborted one of her earlier pregnancies. Her parents are raising a child she gave birth to from the other pregnancy.

"I frankly felt it would be cowardly for me not to address it," Harms said Tuesday.

Retired Appeals Court Judge Rudolph Kass called the decision by BU "unfortunate."

"You don't want judges sniffing at the winds to see what's popular," Kass said. "They should be trying to do what's right in the circumstances."

Republican presidential candidate Newt Gingrich is dangling the prospect of gas as low as $2 a gallon if he's elected.

The former House speaker has spoken in the past of gas dropping to $2.50 a gallon under a Gingrich administration. Monday's prediction, coming as Gingrich campaigned in Oklahoma, contrasts sharply with rival Rick Santorum, who told an Ohio audience that big-city Americans should brace themselves for $5-a-gallon gas.

Both candidates are citing new sensitivity over rising pump prices to push for relaxed regulation on domestic oil production.

According to AAA's daily fuel gauge, the national average Monday for a gallon of regular gas was $3.56.

Gingrich and Santorum have been highlighting oil exploration in North Dakota and slamming the Obama administration for delaying a Canada-to-Texas oil pipeline.

Santorum focused on fears of prices climbing to record highs while campaigning in Ohio.

The former Pennsylvania senator blamed Obama for failing to drill aggressively for more oil and gas in the U.S.

Santorum said the economy has begun to improve slightly but "all of a sudden we're going to be hit with the same force of wind that hit us in 2008, in the summer, that caused us to go into a recession, all because of the radical environmentalist policies of this president."

Gingrich and Santorum have been highlighting oil exploration in North Dakota and slamming the Obama administration for delaying a Canada-to-Texas oil pipeline they say could mean cheaper fuel.

NEW YORK (AP) ? They won't be there in person, but singer Whitney Houston's millions of fans worldwide will be able to share in her homecoming service Saturday as they watch her private funeral on the Internet.

It will provide a much-needed connection for fans who have lacked a formal place to eulogize Houston, one of the world's best-selling artists who died in Beverly Hills, Calif., on Saturday at the age of 48.

Some have gathered and placed flowers outside the Newark, N.J., church where the funeral will be held by invitation-only at the request of Houston's family, who wish to maintain some privacy. Others have stopped by the funeral home. But many have longed to share more fully in commemorating the superstar's life, and have shown their grief in one of the few ways available to them ? by buying her music.

Houston's funeral will be at New Hope Baptist Church, where she sang as a child. Her eulogy will be given by gospel singer Marvin Winans, a Grammy Award winner and longtime family friend. Afterward, Houston will be buried in Fair View Cemetery in Westfield, N.J., according to her death certificate. Her father, John Russell Houston Jr., was buried there in 2003.

Meanwhile, in Los Angeles, investigators for the coroner's office have subpoenaed records from the singer's doctors and pharmacies who dispensed medication found in the hotel room where she died.

Assistant Chief Coroner Ed Winter said such inquiries are routine in virtually all death investigations.

Investigators have not said what medications they have recovered from Houston's room at the Beverly Hilton Hotel. The singer was found underwater in a bathtub by a member of her staff hours before she planned to attend a chic pre-Grammy gala. Police have said there were no signs of foul play and Winter said there were no signs of trauma on her body when an autopsy was conducted on Sunday.

It will be weeks before toxicology results reveal the medications and quantities, if any, that were in Houston's system when she died. The Grammy winner's history of substance abuse has added to the speculation that her death may have been caused by prescription drugs.

In a 2009 interview with Oprah Winfrey, Houston talked about how she was deeply shaken by the death of singer Michael Jackson. Jackson died at age 51 that year from an overdose of the anesthetic propofol.

Houston recalled taping a show celebrating Jackson's 30th anniversary celebration in 2001. Both stars were strikingly thin.

"I was getting scared," she told Winfrey. "I was looking at myself going, 'No, I don't want this to be like this. This can't happen. Not both of us.'"

Like Jackson, Houston was on the verge of a career comeback before her death on Feb. 11. And, like Jackson, sales of her recordings have soared since her passing as fans try to recapture her glory days in the 1980s and 1990s. Old recordings have been propelled to the top of sales charts on iTunes and Amazon.com.

Houston's publicist, Kristen Foster, announced Wednesday that The Associated Press will be allowed a camera at Saturday's funeral in Newark. The AP will stream the service on http://livestream.com/aplive. The event also will be available to broadcasters via satellite.
