Automotive Lawsuit History Unearthed, Junkyard Style: The Ford ...

For decades, I?ve been seeing Ford-family vehicles with ugly, pointless warning labels stuck to their instrument panels: Unexpected and possibly sudden vehicle movement may occur if these precautions are not taken. I?d always assumed that these were ex-rental cars, but after I mentioned the warning stickers in this week?s ?75 Ford Maverick Junkyard Find post, several readers pointed out that the stickers were the result of Malaise Era litigation. Of course!
It turns out that many Ford automatic transmissions of the 1966-1980 period developed a tendency to slip from Park to Reverse, on their own, leading to lots of unpleasantness (if we are to believe Ralph Nader?s Center For Auto Safety, this problem caused 6,000 accidents, 1,710 injuries, and 98 fatalities). Since we?re talking about something like 23 million vehicles here, Ford resisted launching the biggest recall in automotive-industry history; the DOT agreed in 1980 to have Ford send out warning labels to the 23 million affected owners. Some of them used the stickers, most didn?t, and we still see them from time to time in junked Fords, Lincolns, and Mercurys. So, another bit of junkyard-learned Malaise Era automotive history, a nice chaser to the story of the FLOOR TEMP warning light.

2 dead, 12 hurt in Fla. funeral home shooting

MIAMI -- At least one gunman opened fire on a crowd or mourners gathered at a Miami-area funeral home, killing two people and injuring 12, authorities said.

The shooting happened Friday night at Funeraria Latina Emanuel in the North Miami area. More than 100 people were gathered outside the funeral home when?a car drove by and at least one person inside the vehicle fired shots, reportedly with a high-powered weapon, the Miami Herald reported.

"Horror, it was horrible and it was sounds of horror," said pastor A.D. Lenoir of Westview Baptist Church, NBC 6 Miami reported.

Lenoir had just finished officiating the service for 21-year-old Marvin Andre, who was killed in a March 18 shooting, according to witnesses. He was buried at nearby Southern Memorial Park Saturday morning

Among the injured was a 5-year-old girl, McKayla Bazile, according to authorities.

"I grabbed her so we could go and she was screaming and I'm like 'why are you screaming,' I thought she was scared," said Someta Etienne, WSVN-TV reported.?"Then I saw the blood coming from her pants."

Alvaro Zabaleta of Miami-Dade Police said that it is too early to determine the motive for the shooting.

"Whenever you have these types of services, you have a lot of people present, they all become witnesses," Zabaleta said. "Too early to tell what the motive may be and if the person in the viewing has anything to do with it."

An eyewitness told NBC 6 that a suspect in a white Pontiac opened fire on people as they waited outside for their turn to view the body.

"I was in the foyer, shaking hands, galvanizing with the people and shots were fired," said Lenoir.

Police were looking for six men who were in a white 2006 or 2009 Pontiac or Impala, according to WSVN-TV.

How Do Artists Protect Their Work Online?

In ?the wake of the recent discussions about copyright sparked by Pinterest?s Terms of Service, I thought it would be informative to answer the question, ?How do artists protect their work online??

Here are the answers from a spectrum of science-artists.

?Most of what I sell online is original watercolor paintings and collages. I think that makes it a little less risky for me, as far as having my images ripped off, because it?s very hard for someone to recreate the look and the texture of an original using an image from the web. But I know that someone could take one of my designs and put it on a t-shirt or a notebook.
On the other hand, I?ve been featured on lots of blogs and gotten show opportunities because people have seen my work online. The bottom line for me is that having lots of pictures of my work on the web has been worth the risk. So far, anyway!?

I place a value on the work I create, therefore I believe it?s worthwhile to do what I can to protect it from infringement. There are a few websites I use to promote my business, so it?s necessary for me to put samples of my work online. I make them relatively small and/or I place a watermark on them. I?m well aware that it?s not a perfect system, but in my mind doing nothing to protect my images might indicate that I do not value them and it would be a disservice to the clients who commissioned them. Some might perceive that trying to protect one?s work online is futile, but I wholeheartedly believe that just because an endeavor is perceived as futile doesn?t mean it isn?t worth the attempt.

By all means use my photographs! They don?t do anyone any good just?sitting on my hard drives. But be respectful of the fact they take?time and money to create. At least have the decency to inform people?where they came from. And if you are using the photographs to make?money, I deserve some of it. After all, these photographs would not?exist, and could not exist, if I was unable to earn a basic living.

Every time an artist puts their work online, it?s a trade-off. Sure, it could be ripped off. However, in science-art, the audience-niche can be very small. I often paint fossilized winged trilobites on stone, and at the moment the audience who enjoys these paintings is not huge.

A niche audience has benefits. By blogging, tweeting and being a part of the science social media world, I gain community, friends, fans and clients. The benefit of community is that its members will also help to protect you and your artistic work.

Allowing artwork to be shared under Creative Commons is essential to community-building. It helps an artist gain recognition among people who enjoy the artwork, growing the community of people who respect your contributions.

I put my name and url on my artwork; I put my name in the image filenames. From my experience, the artists in the greatest danger are those who?s online presence is obscure. Engage, and the community grows along with your career, as well as being half the fun.

Definitely post your artwork on the web, as publicity is always a good thing. The only true theft to be worried about is a?publisher sniping it in my opinion,?but this is easy to prevent?by simply uploading a lower resolution version of the piece?requiring?a real publication?to approach you for a higher quality version. As for people cross-posting your work, I won?t worry as much about?a lack of credit (though that is annoying), but rather the purposes?and use of the work is often more?of a problem in my opinion?(in?my case creationists).?To make sure unwanted entities aren?t using your work it is?definitely?a good idea to?use?Tineye.

The benefits of sharing and promoting my work online far outweigh the potential losses of someone stealing an image off my web page for profit. Additionally,?I don?t know of a way to protect your art online without seriously damaging the presentation. Watermarks, for example, prevent any real appreciation of the work. So my best advice is to upload images that look great in your online portfolio, but are not hi-res,?with your url small and tastefully in the corner.?In the very rare case that Big Company Inc. steals your image for their Big Marketing Campaign then I?m sure you can find a lawyer happy to help you both out.

If by ?protecting artwork online? you mean preventing someone from gaining access to your web based images ? you can?t.
All of the silly right-click defeating JavaScripts and clear GIF overlays in the world won?t deter a simple third party screen capture utility. A graphics professional such as myself can extract images from Zoomify boxes and Flash files and, to a large extent, even remove watermarking.
The only way watermarking can prevent image use is if it?s so onerous as to render your image unusable for anything, including promoting your art. Keeping images too small to reproduce elsewhere likewise makes them too small to be useful for showcasing your work. Invisible embedded watermarks, which add a layer of ?noise?, can degrade image quality as well.
If your work is in print, anyone with access to a $50 scanner with a de-screening option can make a much higher resolution copy of your images than you are ever likely to put online.

The single best way to protect your images is to register them with the Copyright Office (they don?t have to be published, you can register an ?unpublished collection? of multiple images).
For image files posted online, a simple copyright line and the addition of your domain name, placed on the image in a way that doesn?t detract from the effective presentation of your art, increase the chances for image credit to find its way back to you if the image gets reused, and provide the ability to say legally that the initial version of the image was identified as yours.
It may also be worth adding your domain name to the filename of the image (people are lazy, and will likely just use your original image file, unless you force them into a screen capture), e.g. ?dinosaurcartoons_com_600.gif? (extra dots ?.? are not allowed in a web ?filename).
If you need to be absolutely certain your images are safe, put them in a drawer and don?t let anyone see them.

TX Professor Fired for Refusing to Watch Vulgar Gay Pride Play at Lamar University

Wow, this happened right here in southeast Texas.

A theater arts department professor, Linda Ozmun, at Lamar University in Beaumont, TX had no problem doing her job. She was teaching kids about theater arts. That was her job and she was doing it just fine. The school wanted more than that though. According to a lawsuit that the terminated professor filed, the school chairwoman Judith Sebesta, and eventually the Dean, told her that she had to attend a vulgar gay pride play, by Tim Miller, or else she would be terminated. The professor is a Christian who did not want to go to a vulgar gay pride play. It was not part of her job, and she would not be working at the play. The school just wanted her to personally go see the play. This play had been planned once before at the college, but it was cancelled after the community complained that it would be too offensive and vulgar. The play was brought back though and the professor requested a reasonable accommodation to be excused from attending this offensive production. The dean of her college refused this simple accommodation and threatened plaintiff with disciplinary action if she failed to attend the performance. Because of her religious beliefs, plaintiff failed to attend the performance and as a result she was disciplined for her religious beliefs. Lamar University has discriminated against this professor on the basis of her religious beliefs in violation of the Texas anti-discrimination laws.

As Americans, we should tolerate other lifestyles. On the other hand, Americans should never be forced to accept an alternate lifestyle as normal or be forced to go to a gay pride play in violation of that person's Christian beliefs. That is the homosexual agenda though. They claim they just want to be tolerated, but in reality, they will not be happy until they have forced Americans to accept their lifestyle as normal and right. They will not be happy until they force Christian organizations to provide health coverage that includes sex changes. They will not be happy until they have indoctrinated our children that they are bad if they do not agree with homosexuality, like this Fort Worth, TX kid who got suspended for simply BELIEVING that homosexuality is wrong. They will not be happy until they have forced states to recognize their relationships as a marriage even though the people have voted that marriage is only between a man and a woman.

Gay Dances Were Too Much, Professor Says

BEAUMONT, Texas (CN) - A former tenure-track theater and dance professor claims in court that Lamar University administrators unfairly reprimanded her for refusing, for religious reasons, not to attend a gay performance artist's show on campus.

Linda Ozmun sued Lamar University and its Theater and Dance Department Chairwoman Judith Sebesta, in Jefferson County Court.

"In the fall of 2010, the Department of Theatre and Dance wanted to bring to campus an 'artist' named Tim Miller," Ozmun says in her complaint. "Mr. Miller is an openly homosexual man who advocates for normalizing sexuality and for homosexual marriage.

"His one-man show is about his homosexual lifestyle using obscene language and sexual gestures. As a result of complaints from the community, his visit along with his performance was canceled.

"In response to the cancellation, several theatre students organized a show called 'Coming Out Collective.' It was billed as a celebration of homosexuality.

"Because of her religious beliefs, plaintiff did not attend the show. After the show in December 2010, defendant Judith Sebesta, chair of the department questioned plaintiff as to why she failed to attend the event.

"Plaintiff explained to Mrs. Sebesta that her religious beliefs prevented her from attending the event."

Ozmun, who was in her fourth year teaching at the university, says that in her annual review, Sebesta "included plaintiff's failure to attend the event as part of her evaluation, and gave her a grade of 'unacceptable.'"

Ozmun claims she then "followed university policies and filed a grievance, which was returned and noted 'unheard.'"

When the university decided to bring Tim Miller back to perform his show, Ozmun says, the college dean "threatened plaintiff with disciplinary action if she failed to attend the performance."

"In the fall of 2011 semester, the University did bring Tim Miller ... to Lamar," the complaint states. "The purpose was two-fold: Perform his show 'Glory Box,' and conduct a workshop and student performance with students of Lamar 'to help them find their voice.' Plaintiff contacted defendant and requested a reasonable accommodation to be excused from attending this offensive production. The dean of her college refused this simple accommodation and threatened plaintiff with disciplinary action if she failed to attend the performance.

"Because of her religious beliefs, plaintiff failed to attend the performance and as a result she was disciplined for her religious beliefs.

"Defendants have discriminated against plaintiff on the basis of her religious beliefs in violation of the Texas anti-discrimination laws."

Ozmun says the university also retaliated against her for filing a discrimination claim against it. Ozmun no longer teaches at Lamar University.

She seeks, lost wages, actual damages, punitive damages and "reinstatement of her position with any adverse evaluations expunged from her record."

Ozmun is represented by Barry Bennett with Eddins & Bennett and Michael McGown with Benckenstein, Norvell & Nathan, both of Beaumont.
